These Terms and Conditions (“Terms”) govern your use of designerfragrances.store (the “Website”) and your purchases from IBN Fragrances LLC (“we,” “us,” “our”). By using the Website or placing an order, you agree to these Terms, our Privacy Policy, and our Refund and Returns Policy. If you do not agree, please do not use the Website.

1. Eligibility

You must be at least 18 years old and able to enter into a binding contract to place an order. By ordering, you confirm that the information you provide is accurate and complete.

2. Products and Descriptions

We sell designer fragrances and related products. We try to describe and photograph products accurately, but colors, packaging, and bottle designs may vary slightly from what is shown, as manufacturers update their packaging from time to time. Product sizes and quantities are stated on each product page.

All products are sold as authentic. We are an independent retailer and are not affiliated with, endorsed by, or sponsored by any fragrance brand or designer. Brand names are used only to identify the products we sell, and all trademarks belong to their respective owners.

3. Orders and Acceptance

Placing an order is an offer to buy. We accept it when we send a shipping confirmation, and only then does a binding contract form. We may refuse or cancel any order, for example due to stock errors, pricing errors, suspected fraud, payment failure, or restrictions on shipping to your location. If we cancel an order after payment, we will give you a full refund.

4. Pricing and Payment

  • Prices are shown in the currency displayed at checkout and may change without notice. The price at the time of your order applies.
  • We accept Visa and Mastercard. Payment is processed securely by a third-party provider, and we do not store your full card details.
  • Your card is charged when you place the order. You confirm that you are authorized to use the card.
  • We may carry out fraud checks and ask for identity verification before dispatching an order.
  • Where we make a pricing error, we may cancel the order and refund you, or offer you the chance to reorder at the correct price.

5. Taxes, Customs, and Duties

Prices may or may not include sales tax, VAT, or GST, depending on your location and what is shown at checkout. For international orders, you are responsible for any import duties, customs fees, or taxes charged by your country (including the UK, Australia, and the UAE). These charges are set by the authorities, not by us, and are payable in addition to the order total unless stated otherwise at checkout.

6. Shipping and Delivery

  • We ship to the United Kingdom, United States, Australia, and the United Arab Emirates.

  • Delivery times shown are estimates, not guarantees. Delays may occur due to customs, weather, or carrier issues.
  • Risk of loss passes to you when the carrier delivers the order to the address you provided. Ownership passes to you when we receive full payment.
  • Please check your address carefully. We are not responsible for orders delivered to an incorrect address that you provided.
  • Some countries restrict the import of fragrances (for example, because they contain alcohol or flammable liquids). It is your responsibility to make sure the products you order can legally be imported to your country.

7. Dangerous Goods and Shipping Restrictions

Fragrances are flammable liquids and may be subject to air and postal shipping restrictions. We may therefore ship certain items only by ground or surface services, which can affect delivery times, and we may be unable to ship some items to some locations.

8. Returns, Refunds, and Cancellations

Returns, refunds, exchanges, and cancellations are governed by our Refund and Returns Policy, which forms part of these Terms.

9. Product Use and Safety

Fragrances are for external use only. They are flammable, so keep them away from heat, flames, and children. Avoid contact with eyes. Discontinue use if irritation occurs. Check the ingredient list on the packaging before use if you have allergies or sensitivities. We are not responsible for allergic reactions where ingredients are listed on the product packaging.

10. Accounts

If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or close accounts that breach these Terms.

11. Acceptable Use

You agree not to:

  • Use the Website for any unlawful or fraudulent purpose
  • Place orders using stolen or unauthorized payment details
  • Place orders for resale in commercial quantities without our written permission
  • Attempt to hack, disrupt, or overload the Website, or introduce viruses or malicious code

  • Misuse promotions, discount codes, or return processes

Promotions and discount codes are subject to any terms stated with the offer. Unless stated otherwise, codes cannot be combined, have no cash value, and may be withdrawn at any time. We may cancel orders where a code has been misused.

To the fullest extent permitted by law, IBN Fragrances LLC and its owners, members, employees, and affiliates will not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill, arising from your use of the Website or products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

18. Your Statutory Consumer Rights

Nothing in these Terms affects your mandatory legal rights as a consumer:

  • UK: your rights under the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013, including the right to goods that are of satisfactory quality, fit for purpose, and as described.
  • Australia: the consumer guarantees under the Australian Consumer Law, which cannot be excluded. These include a remedy for major failures, such as a replacement or refund.

You agree to indemnify and hold harmless IBN Fragrances LLC from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Website, to the extent permitted by law.

20. Force Majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, strikes, carrier or customs delays, supply disruptions, war, pandemics, internet or power failures, or government action.

21. Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Wyoming, and you consent to that jurisdiction.

Before starting any formal proceedings, please contact us at support@designerfragrances.store so we can try to resolve the matter informally within 30 days.

Consumers outside the US: if you live in the UK, Australia, or the UAE, this clause does not remove any right you have to bring a claim in your local courts or to rely on the mandatory consumer protection laws of your country.

23. Changes to These Terms

We may update these Terms from time to time. Updated Terms take effect when posted on the Website with a new effective date. The Terms in force when you place an order apply to that order.

24. Severability and Entire Agreement

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with our Privacy Policy and Refund and Returns Policy, form the entire agreement between you and us.
